COMES NOW Paul Andrew Mitchell, Plaintiff in the above entitled case, Citizen of California, Private Attorney General and Federal Witness, to file this, His SECOND NOTICE OF REFUSAL FOR CAUSE, BY AFFIDAVIT, and to serve same on all interested Party(s).

 

CAUSES FOR REFUSING MAGISTRATE’S ORDERS

The statute at 28 U.S.C. 631 clearly authorizes United States Magistrate Judges to conduct proceedings in the United States District Court (“USDC”), but it does not authorize United States Magistrate Judges to conduct proceedings in the District Court of the United States (“DCUS”).

Confer at “Inclusio unius est exclusio alterius” in Black’s Law Dictionary, Sixth Edition.

Statutes granting original jurisdiction to federal district courts must be strictly construed.  [numerous cites omitted]

On August 1, 2001 A.D. ‑‑ the date on which the instant case was first filed ‑‑ the Clerk presented Plaintiff with an unsigned pro forma pleading captioned “CONSENT TO PROCEED BEFORE UNITED STATES MAGISTRATE JUDGE”.  See 28 U.S.C. 636(c), as cited therein.

Plaintiff never signed said pleading and, therefore, Plaintiff never consented to proceed before a United States Magistrate Judge in this Article III DCUS.

Even if Plaintiff had consented to proceed before a United States Magistrate Judge, such consent would not have granted jurisdiction for the latter to conduct any proceedings in this Article III DCUS.

Jurisdiction is never presumed and can never be waived.  See U.S. v. Rogers, 23 F. 658 (DCUS Ark. 1885).

 

INCORPORATION OF EVIDENTIARY DOCUMENTS

In support of Plaintiff’s testimony supra, Plaintiff hereby incorporates by reference, as if set forth fully herein, the AUTHOR’S VERIFIED CRIMINAL COMPLAINT filed concurrently herewith, charging Dale A. Drozd with one count of violating 28 U.S.C. 454 (a high misdemeanor) and demanding his immediate recusal.

 

STANDING OBJECTION TO MAGISTRATE JUDGE

Accordingly, Plaintiff hereby notoriously objects to any and all action(s) allegedly taken by any United States Magistrate Judge(s) in the instant case ‑‑ whether past, present, or future ‑‑ for lacking jurisdiction to proceed in the first instance.
