COMES NOW Paul Andrew Mitchell, Plaintiff in the above entitled case, Citizen of California, Private Attorney General and Federal Witness, to file this, His DECLARATION IN SUPPORT OF ALL SUBPOENAS FOR SUBSCRIBER IDENTITIES.
Pursuant to the requirements of 17 U.S.C. 512(h)(2)(C), Plaintiff hereby verifies that the purpose for which the SUBPOENAS are sought is to obtain the identities of certain alleged infringers of Plaintiff’s exclusive copyrights, and such information will only be used for the purpose of protecting His fundamental Rights as secured by the U.S. Constitution and the Copyright Act of 1976, as lawfully amended.
Statutes granting original jurisdiction to federal district courts must be strictly construed [numerous cites omitted here]. See 17 U.S.C. 512(h)(1) (United States district court [sic]).
In compliance with the itemized requirements of 17 U.S.C. 512(c)(3)(A), Plaintiff attaches His NOTIFICATION OF CLAIMED INFRINGEMENT as required by 17 U.S.C. 512(h)(2)(A), and incorporates same by reference, as if set forth fully herein. See Attachment “A”.
Plaintiff also re-incorporates Exhibits J-1 thru J-97 inclusive, and K-1 thru K-63 inclusive, as previously filed in the District Court of the United States [sic], and as previously incorporated by reference in Plaintiff’s Initial COMPLAINT and three (3) SUPPLEMENTS.
Said Exhibits form a partial basis for obtaining the specific information to be itemized in separate SUBPOENAS, and in additional DEMANDS FOR SUBSCRIBER IDENTITIES, to follow shortly.
