NOTICE OF PEREMPTORY RECUSAL

TO:       Hon. Janis Sammartino, Judge

Superior Court of the State of California

FROM:     Paul Andrew Mitchell, Plaintiff

Mitchell v. AOL Time Warner, Inc. et al.

          Superior Court docket #GIC807057

DATE:     June 2, 2006 A.D.

SUBJECT:  peremptory recusal

Greetings Ms. Sammartino:

The evidence of your stubborn and persistent negligence in the above entitled matter now amounts to probable cause to charge you formally with obstruction of justice, aiding and abetting a protection racket, and being an accessory after the fact to federal witness retaliation and all other RICO predicate acts alleged in the INITIAL COMPLAINT.

Accordingly, you now leave me no alternative but to exercise my right to disqualify you from any further involvement in this matter.

Do not trespass upon my estate or otherwise violate any of my Rights ever again, Ms. Sammartino.  Your failure to comply will give me further probable cause to execute a proper Citizen’s Arrest upon your person, due mainly to the felony conspiracy in which you now appear to be complicit, and also aiding and abetting.

Sincerely yours,

/s/ Paul Andrew Mitchell
