Subject: Freedom of Information Act (“FOIA”) Request
Dear Appeal Officer:
This is a proper and lawful Appeal under the Freedom of Information Act (“FOIA”).
On July 25, 2007 A.D., I requested documents under the FOIA (see attached copy of my original FOIA request). To date, I have not received a complete reply to that FOIA request.
Specifically, PRESIDENTIAL COMMISSIONS are required of all U.S. Tax Court judges by the federal statute at IRC 7443(b).
To my knowledge, Congress has not designated a legal custodian of the SENATE CONFIRMATION which is also required by IRC 7443(b).
For your information, Mr. Robert R. Di Trolio is now refusing to produce specific APPOINTMENT AFFIDAVITS required by 5 U.S.C. 3331, even though 5 U.S.C. 2906 designates the Clerk of the U.S. Tax Court as the legal custodian of that credential. (See attached.)
At least thirty (30) working days have now transpired since the date of that original request (7/25/2007 A.D.)
I hereby appeal your failure to reply timely with all requested documents.
You now have twenty (20) working days to respond to this Appeal. See statute of limitations in the Freedom of Information Act.
