I have now followed the HHS /
OIG instructions for lodging a formal COMPLAINT of
fraud by Dr. Anthony S. Fauci,
based primarily on the prohibition at 5 U.S.C. 5507
(Federal officer may not be paid
without valid APPOINTMENT AFFIDAVITS):
("may not be paid until
the affidavit has been filed")
I wish hereby to
reserve all rights to Qui Tam Awards authorized by the
False Claims Act at
31 U.S.C. 3729 et seq.
If Dr. Fauci
fails to produce evidence of valid APPOINTMENT AFFIDAVITS,
our reading of Section 5507 supra
justifies the conclusion that all federal pay
received by him to date must be
returned to the Treasury of the United States.
Under separate email cover, you
should already have received an email copy
of my original FOIA Request for
Dr. Fauci's APPOINTMENT AFFIDAVITS.
As a matter of fact, which your
subordinates may confirm easily,
that FOIA Request is now PAST DUE. Furthermore, to date I have
not received any
acknowledgment(s) from the NIAID FOIA Coordinator --
See 5 U.S.C. 552 and its
implementing Regulations, for applicable
details in the Freedom of
Information Act.
See also 5 U.S.C. 2906 for the
designated legal custodians of all
APPOINTMENT AFFIDAVITS required
by 5 U.S.C. 3331, 3332, 3333.
I also intend hereby to satisfy
all legal obligations imposed by the
Federal criminal statute at 18
U.S.C. 4, because violations of
18 U.S.C. 912 are FELONY federal
offenses.
