MacDonald, D.C., Trustee for named Defendants Desert Health Trust and Generations Enterprises Trust in the above entitled case (hereinafter “Trustee”) – without conferring, waiving, or otherwise granting jurisdiction – to demand mandatory judicial Notice by this honorable Court of the document incorporated by reference infra, containing relevant adjudicative facts, and to provide formal written notice to all interested party(s) of same.

 

INCORPORATION OF CERTIFIED DOCUMENT

In support of the instant DEMAND, Trustee hereby attaches a true and correct copy of the pleading entitled FIRST SUPPLEMENT TO MOTION FOR INTERLOCUTORY JUDGMENT, AND CHALLENGE TO THE CONSTITUTIONALITY OF AN ACT OF CONGRESS, Mitchell v. AOL Time Warner, Inc. et al., DCUS Sacramento, docket number #CIV. S-01-1480 WBD DAD PS, and incorporates same by reference to Attachment “A” infra, as if set forth fully here.

In contrast to discretionary judicial notice, mandatory judicial notice leaves no room whatsoever for discretion on the part of this honorable United States District Court.
