Routine Proposal to publish all BAR licenses on the Internet

 

Greetings Rep. Burchett:

 

I think you are THE BEST U.S. Representative to accept this simple challenge

and champion it to a very positive and very useful accomplishment:

 

In plain language, The Credential Investigation would be honored 

if you will consider sponsoring new Federal legislation to:

 

(a)  require all 50 State + 1 DC BAR organizations to publish electronic copies

of their mandatory credentials, including but not limited to certificates of admission,

certificates of oath, and certificates of good standing (aka "licenses").

 

(b)  to eliminate permanently the many problems already encountered

by The Credential Investigation, our simple suggestion is explained below,

using 2 redundant hard copies to facilitate routine inspection and data security;

 

(c)  ultimately, the People should be able to access these credentials

quickly by performing a "member search" at each BAR's website, and

simply clicking on links to the front and back sides of all mandatory documents.

 

Thinking out loud here, we believe this one project would be a terrific way

for one or more of your D.C. interns to begin formulating the elements 

of the initial Bill you will sponsor to formalize appropriate legislation.

 

Assuming this limited project meets with worthy success,

it should then be expanded to publish on the Internet 

all mandatory credentials required of all U.S. Government 

officers and employees, no exceptions.

I've conceived of one simple solution to the problems encountered to date:

 

2 original "licenses" are printed on heavy paper,

each with a CERTIFICATE OF ADMISSION and a CERTIFICATE OF OATH,

and mailed to the newly admitted BAR "member" (licensee):

 

Both "licenses" show a CERTIFICATE OF ADMISSION on the front side,

and a CERTIFICATE OF OATH on the back side.

 

Both front sides are already completed by the Supreme Court Clerk.

 

Both back sides are completed with the member's signature and

the signature of the administering officer, date, etc.

 

All 4 signatures must use wet ink, not an electronic format.

 

One completed "license" is mailed back to the BAR --

one original sheet of paper with 2 sides:  front and back.

 

The other is kept in the legal custody of the member

e.g. and ideally mounted on his office wall.

 

The licensed member is free to make photocopies

of both sides, as needed to satisfy client requests

to inspect both sides.

 

Ultimately, all 50 State + 1 DC BARs will be required to publish

electronic copies of these original "licenses" on the Internet, 

for easy access and for routine inspections by the public.

 

Such access means that BOTH SIDES of all licenses

can be rapidly viewed on the Internet with 2 clicks of a mouse.
