COMES NOW  LeRoy  Michael,  Schweitzer,  Sui  Juris,  Citizen  of

Montana  state  and  Respondent  in  the  above  entitled  matter

(hereinafter  "Respondent"),  respectfully  to  Demand  mandatory

judicial notice  by this honorable Court, pursuant to Rule 201(d)

of the Federal Rules of Evidence, of the PUBLIC NOTICE OF DEFAULT

AND OF  INTENT TO  COMPEL PRODUCTION  OF THE  REQUESTED DOCUMENTS

(hereinafter  "PUBLIC  NOTICE")  which  is  attached  hereto  and

incorporated by  reference as  if set  forth fully herein, and to

provide formal Notice to all interested party(s) of same.


         Notice & Demand for Mandatory Judicial Notice:

     The language of Rule 201(d) leaves no room for discretion on

the part  of  this  Court.    Specifically,  the  language  "When

mandatory" and  "shall" clearly denotes an imperative meaning, to

wit:

     (d)   When mandatory.  A court shall take judicial notice if
     requested  by  a  party  and  supplied  with  the  necessary
     information.
