COMES NOW  LeRoy  Michael,  Schweitzer,  Sui  Juris,  Citizen  of

Montana  state  and  Respondent  in  the  above  entitled  matter

(hereinafter  "Respondent"),  respectfully  to  Demand  mandatory

judicial notice  by this honorable Court, pursuant to Rule 201(d)

of the  Federal Rules of Evidence, of the certified copies of the

following  documents,   and  to  provide  formal  Notice  to  all

interested party(s) of same:

     (1)  AFFIDAVIT OF  FALSIFICATION OF RECORD, dated August 16,
          1996 (2 pages total)

     (2)  COMMON LAW AFFIDAVIT AND DECLARATORY JUDGMENT BY RODNEY

Said documents  are attached hereto and incorporated by reference

as if set forth fully herein.

     The language of Rule 201(d) leaves no room for discretion on

the part  of  this  Court.    Specifically,  the  language  "When

mandatory" and  "shall" clearly denotes an imperative meaning, to

wit:

     (d)   When mandatory.  A court shall take judicial notice if
     requested  by  a  party  and  supplied  with  the  necessary
     information.
