COMES NOW the United States (hereinafter “Intervenor”) ex relatione Paul Andrew Mitchell, Citizen of ONE OF the United States of America, Private Attorney General, Criminal Investigator and Federal Witness (hereinafter “Relator”), to demand mandatory judicial Notice by this honorable Circuit Court of all documents attached and incorporated by reference infra, containing relevant adjudicative facts, and to provide formal written notice to all interested Party(s) of same.


INCORPORATION OF ATTACHED DOCUMENTS

In support of the instant DEMAND, Intervenor hereby attaches a true and correct copy of the following documents, and incorporates same by reference to all Attachments infra, as if set forth fully here:

 

(1)           INFORMAL INTERROGATORY transmitted to Mr. Bruce D. Black via Priority U.S. Mail on February 3, 2007 A.D.;

 

(2)           U.S. Postal Service Track & Confirm, Search Results for label serial number #0305 2710 0000 7884 9545 i.e. “Undeliverable as Addressed”;

 

(3)           Note to Mr. Bruce D. Black dated February 7, 2007 A.D., concerning all photocopies attached to his INFORMAL INTERROGATORY supra;

 

(4)           INFORMAL INTERROGATORY transmitted to Mr. W. Daniel Schneider via Priority U.S. Mail on February 3, 2007 A.D.;

 

(5)           U.S. Postal Service Track & Confirm, Search Results for label serial number #0305 2710 0000 7884 9538 i.e. “Delivered at 12:18 PM on February 6, 2007 in Albuquerque, NM 87102”;

 

(6)           INFORMAL INTERROGATORY transmitted to Mr. Matthew J. Dykman via Priority U.S. Mail on February 3, 2007 A.D.;

 

(7)           U.S. Postal Service Track & Confirm, Search Results for label serial number #0305 2710 0000 7884 9521 i.e. “Delivered at 12:18 PM on February 6, 2007 in Albuquerque, NM 87102”;

 

(8)           Printed hard copy of current mailing address of the United States District Court in Albuquerque, New Mexico, as published at the Internet website of that Federal District Court;  and,

 

(9)           Roster of Federal District Judges currently seated on the United States District Court in Albuquerque, showing “Judge Black (Alb)” [sic], as published at the Internet website of that Federal District Court.

 

In contrast to discretionary judicial notice, mandatory judicial notice leaves no room whatsoever for discretion on the part of this honorable U.S. Court of Appeals.


NOTICE OF INTENT TO SUPPLEMENT

THREE INFORMAL INTERROGATORIES

Attached to the three (3) INFORMAL INTERROGATORIES itemized above were scanned copies of all alleged “orders” and similar “process” issued to date by the U.S. District Court that were also readily available in Relator’s hard copy records of the lower court case.

Appellants have reportedly obtained a photocopy of the original “order of sale” allegedly issued by Mr. Bruce D. Black;  they paid the District Clerk for a certified copy of same;  and, they have now transmitted a photocopy of that certified version to Relator via U.S. Mail.

Relator is presently awaiting delivery of that certified photocopy, which is expected in 2-3 days hence circa Feb. 9, 2007 A.D.

As soon as that certified photocopy is delivered to Relator’s Forwarding Agent in downtown San Diego, Relator intends to serve Messrs. Black, Schneider and Dykman with a SUPPLEMENT TO INFORMAL INTERROGATORY, requiring all three (3) personnel to explain why a court seal and signature of the clerk are both missing from same.

Intervenor then intends to demand mandatory judicial notice by this honorable Circuit Court of said certified photocopy, and of Relator’s three (3) SUPPLEMENTs TO INFORMAL INTERROGATORY.

Intervenor hereby objects in advance to any claim(s) that the unconstitutional Abrogation Clause can be used as authority to modify Local Rules permitting electronic “process” to violate 28 U.S.C. 1691.

 

REMEDY DEMANDED

All premises having been duly considered, Intervenor respectfully demands mandatory judicial notice of all documents incorporated supra.
