I write in response to a letter received from "Darlene Berthod, District Director," regarding one of several FOIA requests which were recently sent to Internal Revenue Service. A true and correct photocopy of both sides of this one-sheet letter are enclosed for reference, including an additional copy of the second sheet, marked editorially with red pen.

With regard to this letter, I ask two (2) questions:

  1. With regard to which FOIA request is this letter intended?

    The letter did not specify, and I have several FOIA requests outstanding. Before I can decide whether to continue pursuit of the issue at hand, I must know which issue is, in fact, at hand.

  2. What is the statute or regulation which Internal Revenue Service claims governs this demand upon Me, for proof of identity?

    The claim made by this letter is that I must provide some manner of proof of identity, before Internal Revenue Service will act on a FOIA request. This is most peculiar, given that I have already received response from the Internal Revenue Service with regard to at least 2 other FOIA requests; no such demand for proof of identity was elicited in those cases. The letter claims that, "certain requirements must be met" (page 1), and that "[g]iving out these records is limited by statute or regulations" (page 2).

    I have looked into the matter of what statute or regulation might exist which could limit access to any of the information I have heretofore requested under FOIA, with respect to the question of proof of identity. I am aware of no statute or regulation which requires what this letter claims. Please cite the statute or regulation which, in your opinion, governs such matters.

Time is of the essence. If you have any questions about your rights and obligations under 5 U.S.C. 552, may we recommend that you contact the offices of the Attorney General, or the Solicitor General, in Washington, D.C., for immediate assistance.
