Dear Mr. Blair:

 

On October 18, 2001 A.D., your office was properly served with a SUMMONS and Initial COMPLAINT in the above entitled case.

 

During the following twenty (20) days, our Forwarding Agent and I did not receive any pleadings or any other answer(s) from your office in this case.  This was the deadline for answers as stated on the SUMMONS issued by the Clerk of Court.

 

Recently, however, I received an answer from attorneys for Cornell University, in which your office is listed in their SERVICE LIST (page 12, DECLARATION OF NELSON E. ROTH).

 

If you filed any answer(s) or other pleading(s) at any time after November 7, 2001 A.D., would you kindly re-mail same to My Forwarding Agent listed below?  Later that month, I checked the Clerk’s electronic docket, and I did not find any answer from the University of California, at that time.

 

United Parcel Service is presently unable to pinpoint a shipment of U.S. Mail from our Forwarding Agent sent during the month of December.  It is possible that some (or all) of your mail may be among the documents in that shipment.

 

I will inform you immediately if that shipment is eventually found and if it does contain any U.S. Mail from you.

 

Please also be aware that our former address in Gold River, California, is no longer valid.  I believe that address was shown on the SUMMONS you received.  I have already submitted forwarding orders to the U.S. Postal Service in Gold River, and received their confirmation.

 

Because of the criminal complaint I was obliged to file against 2 individuals there (see 18 U.S.C. 4), it is also quite possible that personnel at the Constitutional Educational Research Foundation (CERF) in Gold River are refusing to forward any of my U.S. Mail that may have been delivered in error to their offices.

 

Please also be aware that the SUMMONS issued to Prof. Donald Hoffman at U.C. Irvine appears to have been lost or misplaced by process servers retained by CERF personnel.  If we are unable to locate that SUMMONS, we will request the Clerk of Court to issue another SUMMONS to Prof. Hoffman and serve him with same.
