Dear Paul Mitchell:

This responds to your correspondence attempting to file an appeal with the Department of State referencing number F-2025-15165.

Please note that the principle administrative function of the OIP is the adjudication of appeals from the denial of access to information pursuant to the Freedom of Information Act (FOIA) and the Privacy Act of 1974 by components of the Department of Justice (DOJ).  OIP also responds to FOIA requests on behalf of the Office of the Attorney General and other senior leadership offices within DOJ.  This Office does not have jurisdiction over records maintained by other federal agencies.  As noted, it appears you have sent your appeal to the Department of State for processing.  I regret that OIP cannot be of any further assistance to you with this matter.

Sincerely,

U.S. Department of Justice

Office of Information Policy

FREEDOM OF INFORMATION ACT APPEAL

Greetings Stephanie G et al.:

Our original FOIA Request dated 3/27/2025 specifically requested

a copy of Mr. Merrick Garland's PRESIDENTIAL COMMISSION:

https://supremelaw.org/rsrc/commissions/garland.merrick/FOIA.Request.2025-03-27/initial.request.2.htm

It is our studied understanding that a PRESIDENTIAL COMMISSION

duly appointing the U.S. Attorney General must be recorded

by the U.S. Secretary of State.  See 5 U.S.C. 2902(a):

https://www.law.cornell.edu/uscode/text/5/2902  (a)

("Secretary of State shall make out and record ....")

Our original FOIA Request did cite and quote Section 2902(a).

We do not believe 5 U.S.C. 2902(c) is the relevant authority chiefly because

it would appear to be a conflict of interest for a newly appointed Attorney General

to countersign his/her own PRESIDENTIAL COMMISSION.

Please accept this brief email message as a proper FOIA Appeal of

our original FOIA Request for Mr. Garland's PRESIDENTIAL COMMISSION.

Thanks again!  And, have a safe and wonderful day, please.
