COMES NOW Paul Andrew Mitchell, Sui Juris, Citizen of Arizona
state, expressly not a citizen of the United States ("federal
citizen"), federal witness, and Relator in the above entitled
matter (hereinafter "Relator"), to provide formal Notice to all
interested party(s), and respectfully to request mandatory
judicial Notice by this honorable Court, pursuant to Rule 201(d)
of the Arizona Rules of Evidence and to Article VI, Section 21,
of the Constitution of the State of Arizona, of this, Relator's
AFFIDAVIT OF DEFAULT, filed for the purpose of testifying to
facts constituting probable cause to conclude that the presiding
judge in the instant matter has omitted to perform a duty imposed
by Arizona law, in violation of ARS 13-108(A)(4) and 13-201.

VERIFICATION
I, Paul Andrew Mitchell, Sui Juris, Citizen of Arizona
state, federal witness, and Relator in the instant case, hereby
verify, under penalty of perjury, under the laws of the United
States of America, without the "United States", that the
following statement of facts is true and correct, to the best of
My current information, knowledge, and belief, so help Me God,
pursuant to 28 U.S.C. 1746(1).
AFFIDAVIT OF DEFAULT
I, Paul Andrew Mitchell, hereinafter Relator in the above
entitled case, hereby verify that:
Relator has carefully studied, and now firmly believes that
the controlling Law in the instant case is Article VI, Section
21, of the Constitution of the State of Arizona, which states:
21. Superior court; speedy decisions
Section 21. Every matter submitted to a judge of the
superior court for his decision shall be decided within
sixty days from the date of submission thereof.
The date of submission of the instant matter was July 16,
1997. Relator believes that this Court was mandated by said Law
to decide the instant matter no later than September 16, 1997.
By midnight on the night of September 16, 1997, Relator had
received absolutely nothing whatsoever from this honorable Court
in the instant matter, nor had Relator received anything
whatsoever from the named Respondent.
Therefore, as a consequence of the facts as stated above,
Relator testifies to the existence of probable cause to conclude
that the judge presently assigned to preside over the instant
matter, has omitted to perform a duty imposed by Arizona law, in
violation of Arizona Revised Statutes 13-108(A)(4) and 13-201.
Further Relator sayeth naught.
