Yes, exactly!  This is one of the statutes
which imposes a specific liability on 
withholding agents.  See the other statutes
which are itemized in the IRC definition
of "withholding agent" at section 7701(a)(16).

Here's the rub:

One does not become a withholding agent until,
and unless, a valid Employee's Withholding 
Allowance Certificate is presented.

The one who does the withholding, is "holding"
money which belongs to the United States.

Until such time as that money is actually paid
to the United States, the withholding agent
is liable, NOT THE EMPLOYEE!!!

Without a valid W-4, there can be no withholding agent,
period!  Think of the W-4 as a Power of Attorney
authorizing the withholding.  Without the authorization,
there can be no lawful withholding.
