Why is it not in the Constitution today?

It IS in the Constitution, as a matter of Law;
but it was removed from the published versions
upon which courts rely, for reasons which are
explained in the essay entitled "Esquires" in
the Supreme Law Library at URL:

  http://www.supremelaw.com

Since that essay was first written, a few 
historical details have been clarified, 
like the exact year in which Virginia put
it over the top (1819, not 1812).
