Sounds like you put the 'cart before the horse'.
: Haven't been here recently but it's nice to see all the good information that has been added.
: Now to a little dilemma that has come apon me.
: I have been using my car for personal travel without any licensing for almost a year now. Unfortunatly I was pulled over a few days ago for allegedly speeding. Well to make a long story sort they were not very knowledgable about my rights and now I have a court date for November 18th.
: I have obtained lots of good information to use but I was wondering if anyone else has had to deal with this particular situation and if so do you have a good suggestion for how I should defend myself.
: The route I am thinking of taking is first off petition for a jury trial. November 18th is actually the date I go to enter my plea. I am thinking of asking the judge to dismiss the cass on the grounds that there is no law, as defined by both Bouviers and Black's law dictionari'es, that requires me to obtain licensing. If this dose not work on the date of the actual trial before a jury I will define both law and statute, from a law dictionary. And then go on to cite cases across the country similar to my own were it has been shown that you do not need to be licensed to use your automobile. And after that I with show how that our consitution guarentees me the right to travel as I see fit. As long as I do not infringe upon someone elses right to life, liberty, or property.
: All input is welcome. If anyone knows of some good Supreme Court ruling's on ether the defenitions of law and statute, or on the right of a person to travel without licensing, please let me know.
: And again ALL INPUT IS WELCOME. This is the first time I have ever had to go to court my knowlegde of court procedings is very lacking all help will be greatly appreciated. Thanks.
