Subject: Rules/Procedures for DCUS?
Most of them are in Title 28.
E.g., see 28 U.S.C. 1861 et seq.
for jury selection policy and
procedure.
Congress blended law and equity,
but only delegated to the
U.S. Supreme Court authority to
promulgate rules for the USDC.
See 28 U.S.C. 2072(a) for proof.
So, it looks as if there is now
a gaping hope in the DCUS, because
the FRCP, FRCrP, and FREvid do not
apply to the DCUS.
More on this later.
