SUBJECT: Notice of Intent to Apply for Writ of Execution
Mitchell v. Nordbrock, PCCJC #CV-97-3438
Judgment Amount: $3,113.42
Dear Constables:
I am writing to inform you of My specific intent to apply to the
Pima County Consolidated Justice Court for a Writ of Execution to
satisfy the final judgment issued upon a unanimous jury verdict
in the case described above.
Sir Lawrence E. Condit, Esquire, has tendered a standard bank
check in the exact amount of the judgment: $3,113.42, and
transmitted same via first class United States Mail.
However, when I visited the downtown Tucson office of Bank of
America yesterday, to confirm the availability of funds, three
(3) separate employees of the Bank of America confirmed to Me, in
Person, that Mr. Condit had placed a STOP PAYMENT order on check
#7013 (see copy enclosed).
They informed Me that his reason for doing so was shown on the
bank's computers as a "wrong amount". This was a lie, because
the Clerk of Court subsequently confirmed the exact amount of the
final judgment, and did so quite graciously; her confirmation
was also consistent with My carbon copy of the final judgment.
Although the judgment debtors have at least two (2) late model
vehicles (an Oldsmobile sedan and a Dodge Ram pickup truck), I do
feel it would be more expedient if My application for Writ of
Execution directed you to obtain cash from Mr. Condit's bank
account at the downtown office of the Bank of America.
This would save you the trouble of towing one or both of these
vehicles, impounding them, and then selling them at auction, in
order to satisfy the judgment amount of $3,113.42. Given that I
have also observed loaded firearms in the hands of Nordbrock
family members, I also think this avenue is the safest for
everyone concerned.
Unless I hear otherwise from you before 5:00 p.m. on Friday,
November 21, 1997, I will proceed according to this plan.
