SUBJECT: legal status of the Universal Declaration of Human Rights
Greetings Department of State:
In “Annex 1: Human Rights Treaty Ratification and Reporting” of the attached “Report of the United States of America Submitted to the U.N. High Commissioner for Human Rights In Conjunction with the Universal Periodic Review,” the Universal Declaration of Human Rights is not listed among the multilateral human rights related treaties to which the United States is a present Party.
Instead, on Pages 26-27 please note the following sentence:
In addition to accepting human rights obligations under the above-referenced treaties to which it is a party, the United States has made human rights commitments through numerous other instruments, including the 1948 Universal Declaration of Human Rights and the 1948 American Declaration of the Rights and Duties of Man.
In light of the above, please kindly confirm whether or not the Congress of the United States has formally ratified the Universal Declaration of Human Rights and, if so, can you please cite the correct Volume and Page numbers in the Statutes at Large where we may confirm such formal ratification?
See also Article II, Section 2, Clause 2, in the Constitution for the United States of America, to wit:
“He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur ....”
