To the Honorable David H. Souter, Associate Justice of the United States and Circuit Justice for the United States Court of Appeals for the Third Circuit:


COMES NOW the United States (“Applicant”) ex relatione Paul Andrew Mitchell, B.A., M.S., Citizen of ONE OF the United States of America, Private Attorney General, Criminal Investigator and Federal Witness (hereinafter “Relator”) to petition Justice John Paul Stevens, now seated on this Honorable Supreme Court of the United States, for:

(1)     the specific emergency relief requested by Plaintiff of record, Philip J. Berg, by granting a STAY of the General Election pending resolution of Plaintiff Philip J. Berg’s Petition for Writ of Certiorari;

(2)     an immediate ORDER granting the United States’ ex rel. APPLICATION FOR LEAVE TO INTERVENE in the instant case;

(3)     an immediate ORDER to the United States Court of Appeals for the Third Circuit timely to adjudicate and rule upon the United States’ ex rel. APPLICATION FOR A WRIT IN THE NATURE OF A PROHIBITION;

(4)     an immediate ORDER vacating the “MEMORANDUM & ORDER” issued by the United States District Court for the Eastern District of Pennsylvania under authority alleged by Mr. R. Barclay Surrick;  and,

(5)     an immediate ORDER to be served upon the Clerk of the United States District Court for the Eastern District of Pennsylvania for timely production, certification and service upon all interested parties of the Office of Personnel Management (“OPM”) Form 61 APPOINTMENT AFFIDAVIT required of Mr. R. Barclay Surrick by Article VI, Clause 3 in the Constitution for the United States of America (“U.S. Constitution”) and by the obligatory Federal statutes at 5 U.S.C. §§ 2906 and 3331.  See Supremacy Clause.
